Terms of Service

1. Agreement
By creating an account or using Arvia ("the Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a binding agreement between you (or the organisation you represent) and Arvia.
2. The Service
Arvia provides an AI agent platform that allows businesses to deploy, configure, and interact with AI assistants. The Service includes the web platform at workspace.arvia.nz, the marketing website at arvia.nz, any mobile applications, and associated APIs.
3. Accounts and eligibility
- You must be at least 18 years old to create an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You are responsible for all activity that occurs under your account.
- You must provide accurate information when creating your account.
4. Subscriptions and billing
- Subscriptions are billed monthly in advance.
- Monthly credits are allocated at the start of each billing period and do not roll over.
- All prices are in USD. Your card may be charged in a different currency at your bank's exchange rate.
- You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No refunds are given for partial months.
- We reserve the right to change pricing with 30 days' notice by email.
5. Acceptable use
You must not use the Service to:
- Violate any applicable law or regulation.
- Generate or distribute illegal, harmful, hateful, or deceptive content.
- Attempt to reverse-engineer, scrape, or copy the Service.
- Circumvent usage limits or access controls.
- Resell or sublicense access to the Service without our written consent.
- Use the Service in a way that damages, disables, or impairs our infrastructure.
We reserve the right to suspend or terminate accounts that violate this policy without notice.
6. AI-generated content
The Service uses AI models to generate responses. You acknowledge that:
- AI outputs may be inaccurate, incomplete, or outdated.
- You are solely responsible for reviewing and acting on AI-generated content.
- Arvia is not liable for any decisions made based on AI outputs.
7. Your data
You retain ownership of all content you submit to the Service. You grant us a limited licence to process and store that content solely to provide the Service. We do not use your data to train AI models. See our Privacy Policy for full details.
8. Intellectual property
All intellectual property in the Service (excluding your content) belongs to Arvia. You may not copy, modify, or create derivative works of the Service or its branding without our prior written consent.
9. Limitation of liability
To the maximum extent permitted by law, Arvia's total liability to you for any claim arising from these Terms or use of the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for any indirect, incidental, or consequential damages.
10. Service availability
We aim for high availability but do not guarantee uninterrupted access. We are not liable for downtime caused by maintenance, third-party service failures, or events outside our control.
11. Governing law
These Terms are governed by the laws of New Zealand. Any disputes will be resolved in the courts of New Zealand.
12. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance.
